• セキュリティおよび不正行為の防止：当社は、アカウントの認証、安全な決済およびショッピング環境の提供、不正行為その他の違法、危険または悪意のある活動の検出・調査・防止、公共の安全の保護、本サービスの安全性の確保などを目的として、お客様の個人情報を利用することがあります。お客様がアカウントを作成して本サービスを利用する場合、ユーザー名、パスワードその他の認証情報を安全に管理する責任はお客様にあります。これらの情報を他の方と共有しないことをおすすめします。
• お客様とのコミュニケーション：当社は、カスタマーサポートの提供、お問い合わせへの対応、本サービスに関するご連絡、サービスの改善、およびお客様との関係の維持を目的として、お客様の個人情報を利用することがあります。
• 法令遵守および法的手続きへの対応：当社は、適用される法令を遵守するため、召喚状、令状その他の法的要請に対応するため、また、行政機関や法執行機関からの要請に対応するために、お客様の個人情報を利用することがあります。また、紛争、訴訟その他の法的手続きの調査・対応、当社の利用規約やその他のポリシーの違反の調査・防止、当社、本サービス、お客様その他の方の権利や安全の保護を目的として、お客様の個人情報を利用することがあります。

個人情報の共有・提供先

当社は、以下の場合に、必要な範囲でお客様の個人情報を第三者と共有または提供することがあります。

• サービスプロバイダー：当社は、IT管理、決済処理、データ分析、カスタマーサポート、クラウドストレージ、商品の注文処理、商品の発送・配送などのサービスを提供する事業者に対し、当社に代わって業務を行うために必要な範囲で、お客様の個人情報を共有することがあります。これらの事業者には、Shopifyその他のサービスプロバイダーが含まれます。
• ビジネスパートナーおよびマーケティングパートナー：当社は、ビジネスパートナーやマーケティングパートナーと連携し、マーケティング活動や広告配信を行うことがあります。たとえば、お客様の複数のウェブサイトやオンラインサービス上での活動に基づき、本サービスや他のウェブサイト上で、お客様に合わせた広告を表示する場合があります。これらのビジネスパートナーやマーケティングパートナーは、それぞれのプライバシーポリシーに従ってお客様の情報を取り扱います。お客様がお住まいの地域によっては、お客様に関する情報を、ターゲティング広告の配信やマーケティング目的で当社と共有しないよう求める権利を有する場合があります。
• お客様の指示または同意に基づく共有：お客様が、商品の発送、ソーシャルメディア機能の利用、ログイン連携その他の目的で、特定の情報を第三者に提供するよう当社に指示、依頼または同意した場合、当社はその指示に従って情報を共有することがあります。
• 関連会社およびグループ会社：当社は、本サービスの提供、運営または改善のため、当社の関連会社その他のグループ会社とお客様の個人情報を共有することがあります。
• 事業上の取引、法令遵守および権利の保護：合併、買収、事業譲渡、破産その他の事業上の取引に関連して、当社はお客様の個人情報を共有することがあります。また、適用される法令、召喚状、令状その他の法的要請に対応するため、当社の利用規約やその他のポリシーを執行するため、また、当社、本サービス、お客様その他の方の権利や安全を保護・擁護するために、お客様の個人情報を共有することがあります。

第三者提供

1. 当社は、お客様の個人情報については、個人情報の保護に関する法律の定める場合のほか、お客様の個別の同意がない限り、第三者に提供しません。ただし、下記3.の第三者提供については、お客様が本ポリシーに同意したことをもって、当該第三者提供を同意したものとみなします。

4. 当社は、お客様から、個人情報保護法の定めに基づき個人情報の第三者提供の停止を求められた場合、お客様ご本人からのご請求であることを確認の上、その求めに理由があることが判明したときは、個人情報の第三者提供の停止を行い、その旨をお客様に通知いたします。
   なお、第三者提供の停止を行わない旨の決定をしたときは、お客様に対しその旨を通知いたします。
   
   
5. 当社は、お客様から、個人情報保護法の定めに基づき、個人情報を第三者に提供し又は提供を受けた際の記録（以下「第三者提供記録」といいます）の開示を求められたときは、お客様ご本人からのご請求であることを確認の上で、お客様に対し、遅滞なくその開示を行います。当該個人情報が存在しないときには、その旨を通知いたします。
   
   
6. 個人情報保護法その他の法令により、当社が第三者提供の停止又は第三者提供記録の開示の義務を負わない場合は、第4項及び第5項の規定は適用されません。

本サービスは、Shopifyが提供するプラットフォーム上で運営されています。Shopifyは、本サービスの提供および改善のため、お客様による本サービスへのアクセスや利用に関連する情報を収集・処理することがあります。

お客様が本サービスを通じて提供した情報は、本サービスの提供および改善のため、Shopifyや、お客様がお住まいの国以外の国に所在する第三者に移転または共有される場合があります。

Shopifyによるお客様の個人情報の利用方法、およびShopifyが取り扱う情報に関してお客様が有する可能性のある権利については、Shopifyのプライバシーポリシーをご確認ください。

お客様がお住まいの地域によっては、Shopifyのプライバシーポータルを通じて、個人情報に関する一定の権利を行使できる場合があります。

本サービスには、第三者が運営するウェブサイトやその他のオンラインプラットフォームへのリンクが含まれる場合があります。

当社が運営または管理していないウェブサイトへのリンクをクリックする場合は、リンク先のプライバシーポリシー、セキュリティポリシーその他の利用規約をご確認ください。

当社は、これらのウェブサイトのプライバシーやセキュリティ、または掲載されている情報の正確性、完全性もしくは信頼性について、保証または責任を負いません。

お客様が公開または限定公開の場で提供する情報は、第三者のソーシャルネットワーキングサービス上で共有する情報を含め、本サービスの他の利用者や当該プラットフォームの利用者に閲覧される場合があります。

当社が本サービス上にこれらのリンクを掲載することは、別途明示されている場合を除き、リンク先のコンテンツ、所有者または運営者を推奨または承認するものではありません。

お子様の個人情報

本サービスは、法定成年年齢未満のお子様を対象としていません。当社は、適用される法令で認められている場合を除き、法定成年年齢未満のお子様の個人情報を故意に収集することはありません。

お子様が当社に個人情報を提供したことを保護者の方が知った場合は、下記の連絡先までご連絡ください。確認のうえ、適用される法令に従って対応します。

本プライバシーポリシーの発効日時点で、当社は、14歳未満の個人の個人情報を、適用される法令で定義される「販売」または「共有」の対象として取り扱っていることを認識していません。

お客様の個人情報の安全管理と保管期間

当社は、個人情報を保護するために合理的な安全管理措置を講じています。ただし、インターネット上の通信や情報の保管について、完全な安全性を保証することはできません。

お客様から当社に送信される情報は、送信中に安全に保護されない可能性があります。機密性の高い情報を当社に送信する場合は、安全性が確認できない通信手段の利用を避けてください。

お客様の個人情報を保管する期間は、アカウントの維持、本サービスの提供、法令上の義務の遵守、紛争の解決、その他の契約上または業務上の必要性などに応じて異なります。

法令に基づく販売記録の保存

当社は、医薬品、医療機器等の品質、有効性及び安全性の確保等に関する法律その他の関連法令に基づき、コンタクトレンズ等の高度管理医療機器の販売に関する記録を3年間保存します。

当該記録には、法令で定められる範囲で、商品名、数量、販売年月日、お客様の氏名及び住所その他の情報が含まれる場合があります。

当該情報は、法令上の義務を履行するため、また、行政機関等からの照会その他の法令上必要な対応を行うために利用・保存します。

お客様の権利と選択肢

お客様がお住まいの地域によっては、お客様の個人情報について、以下の権利の一部または全部を有する場合があります。

ただし、これらの権利は絶対的なものではなく、特定の条件のもとでのみ適用される場合があります。また、適用される法令で認められている場合には、ご請求をお断りすることがあります。

• 個人情報の開示を求める権利：お客様は、当社が保有するお客様の個人情報へのアクセスまたはその開示を求める権利を有する場合があります。
• 個人情報の削除を求める権利：お客様は、当社が保有するお客様の個人情報の削除を求める権利を有する場合があります。
• 個人情報の訂正を求める権利：お客様は、当社が保有する不正確な個人情報の訂正を求める権利を有する場合があります。
• データポータビリティの権利：特定の条件および例外が適用される場合、お客様は、当社が保有するお客様の個人情報のコピーを受け取り、それを第三者に移転するよう当社に求める権利を有する場合があります。
• 配信設定の管理：当社は、プロモーションに関するメールをお送りする場合があります。お客様は、メールに記載された配信停止方法を利用して、いつでもプロモーションメールの配信を停止できます。プロモーションメールの配信を停止した場合でも、ご注文、アカウント、サービスの利用その他の重要な事項に関するメールをお送りすることがあります。
• 台湾にお住まいのお客様：台湾の個人資料保護法（Personal Data Protection Act）が適用される場合、お客様は、適用される法令に基づき、ご自身の個人データについて、照会、閲覧、複製、訂正又は補充、一定の場合における処理・利用の停止、及び削除等を求める権利を有します。

  個人データの正確性に争いがある場合、又は個人データの収集に係る特定の目的が消滅した場合若しくは所定の期間が満了した場合など、法令に定められた要件を満たすときは、お客様は個人データの処理又は利用の停止、削除等を求めることができます。なお、法令上の義務の履行又は業務の遂行に必要な場合その他法令に定められた例外に該当する場合には、個人データの処理又は利用の停止若しくは削除に応じないことがあります。また、台湾の個人資料保護法は、同意に基づく処理について、タイ又は韓国の法令と同一の一般的な「同意撤回権」を独立した権利として規定しているわけではありません。そのため、台湾のお客様からのご請求については、適用される法令上の処理停止、削除その他の権利として取り扱います。

• 韓国にお住まいのお客様：韓国の個人情報保護法（Personal Information Protection Act）が適用される場合、お客様は、ご自身の個人情報について、個人情報の処理停止を要求し、又は個人情報の処理に対する同意を撤回する権利を有します。

  同意を撤回された場合、当社は、適用される法令に従い、当該同意に基づく個人情報の処理を停止し、必要な措置を講じます。ただし、法律に特別な規定がある場合又は法令上の義務を遵守するために個人情報の処理が不可欠である場合、その他韓国の個人情報保護法に定められた例外に該当する場合には、処理停止の請求を拒否することがあります。また、契約の履行に必要な場合など、同意以外の適法な根拠に基づく処理については、同意の撤回のみを理由として処理を停止できない場合があります。

• タイにお住まいのお客様：タイの個人データ保護法（Personal Data Protection Act B.E. 2562 (2019)）が適用される場合、お客様は、適用される法令に基づき、個人データの処理について、同意を撤回する権利及び一定の場合に個人データの収集、利用又は開示に異議を申し立てる権利を有します。

  同意に基づく個人データの処理については、お客様はいつでも同意を撤回することができます。同意の撤回は、撤回前に行われた同意に基づく処理の適法性には影響しません。また、同意の撤回には、法令その他の正当な理由により制限が適用される場合があります。
  また、お客様は、ダイレクトマーケティングを目的とする個人データの処理等について、一定の場合に異議を申し立てることができます。なお、同意の撤回又は異議の申立てがあった場合でも、法令上の義務の履行、契約の履行、法的請求の確立・行使・防御その他の適用される法的根拠に基づき処理が必要な場合には、当該個人データの全部又は一部の処理を継続することがあります。

• 英国または欧州経済領域（EEA）にお住まいのお客様：英国または欧州経済領域（EEA）にお住まいのお客様は、現地の法令に定められた例外および制限に従い、上記の権利に加えて、以下の権利を有する場合があります。

• 個人情報の処理への異議申立ておよび処理の制限：お客様は、特定の目的のために当社が行う個人情報の処理について、異議を申し立てたり、その処理を停止または制限するよう求めたりする権利を有する場合があります。
• 同意の撤回：当社がお客様の同意に基づいて個人情報を処理している場合、お客様はその同意を撤回する権利を有します。同意を撤回した場合でも、撤回前に同意に基づいて行われた個人情報の処理の適法性には影響しません。

お客様は、本サービス上に記載された方法、または下記の連絡先を利用して当社にご連絡いただくことにより、これらの権利を行使できます。Shopifyによるお客様の個人情報の利用方法、およびShopifyが処理するデータに関してお客様が有する可能性のある権利については、以下をご確認ください。

お客様がこれらの権利を行使したことを理由として、当社がお客様を不当に差別することはありません。適用される法令で認められている場合、または義務付けられている場合、当社はご請求を処理する前に、お客様の本人確認をお願いすることがあります。

適用される法令に従い、お客様は、ご自身の権利を行使するために代理人を指定することができます。当社は、代理人からのご請求を受け付ける前に、お客様が代理人に権限を付与したことを示す書類の提出をお願いする場合があります。また、お客様ご本人に直接本人確認をお願いする場合があります。当社は、適用される法令に従って、お客様からのご請求に対応します。

苦情

お客様の個人情報の取扱いについてご不明な点やご不満がある場合は、下記の連絡先までお問い合わせください。お住まいの地域によっては、当社にご連絡いただくほか、地域のデータ保護当局に苦情を申し立てることができます。お客様の個人情報の取扱いについてご質問やご懸念がある場合は、本プライバシーポリシーの末尾に記載された連絡先までお問い合わせください。

国外への個人情報の移転

お客様の個人情報は、お客様がお住まいの国以外の国に移転、保管または処理される場合があります。お客様の個人情報を欧州経済領域（EEA）または英国以外の国に移転する場合、当社は、欧州委員会が定める標準契約条項その他の認められた移転メカニズムを利用します。ただし、移転先の国が十分な水準の個人情報保護を提供していると認められている場合は、この限りではありません。

準拠法及び管轄

本サービスは日本法に準拠するものとし、本規約は日本法によって解釈されます。
本サービスの利用に関し、万が一紛争等が生じた場合には、大阪地方裁判所を第一審の専属的合意管轄裁判所として、その解決に当たるものとします。

本プライバシーポリシーの変更

当社は、業務内容の変更、その他の運営上、法的または規制上の理由を反映するため、本プライバシーポリシーを随時更新することがあります。改訂後のプライバシーポリシーは本ウェブサイトに掲載し、「最終更新日」を更新します。適用される法令で通知が義務付けられている場合は、所定の方法でお知らせします。
